The ex-lawyer for the former president has stepped down as the chief federal prosecutor in the state. This follows a judicial decision that questioned her eligibility to occupy the role.

Official Departure

The head of the Justice Department, Pam Bondi, accepted the prosecutor's departure on the start of the week. She commented that the judicial decision made it unworkable for Habba to effectively run her office.

"Do not interpret compliance for surrender," she declared. "This battle will now extend throughout the country."

Court Ruling

The departure comes a week after a US appeals court found that she had been acting without proper authority as the top prosecutor. This judgment is expected to impact numerous prosecutions in New Jersey.

The judicial panel declared that a temporary posting that did not receive confirmation by the US Senate violated the statute on vacant positions.

The Attorney General added that she will stay on at the DOJ as a senior adviser. Habba plans to pursue additional appeals of the ruling, in the hope of achieving a reversal.

Writing online, Bondi wrote that the judiciary "must not countermand the executive's selection of lawyers responsible for executing the primary duty of the administration of enforcing the law."

The attorney general commended the prosecutor's work and said that while she was in charge, the state capital of Newark saw a one-fifth decrease in offenses. It was also reported that the southern city of Camden recorded its first summer in 50 years free from homicides.

Habba, first joined the former president's legal defense in 2021. She went on to acted for her client in his New York criminal case in the previous year, leading to his conviction on 34 counts of document fraud.

Before Habba took on the top New Jersey post, the former president had revealed he was selecting her as his White House advisor in a potential future term, labeling her as "unwavering in her loyalty" and a relentless legal advocate.
